Face recognition startup Clearview AI fined 17 million pounds



In early 2020, Clearview AI hit the headlines. The New York Times reported at the time that the previously unknown startup had a database of more than three billion images - compiled from images that people had uploaded to publicly accessible platforms such as Facebook and Youtube, but also to the payment service Venmo.


British data protection agency threatens Clearview AI with a £ 17 million fine

As the British data protection authority Information Commissioner's Office (ICO) announced yesterday, Monday, November 29, 2021, Clearview AI is to be fined more than 17 million pounds. In addition, the startup is asked to stop processing data from people from the UK and to delete it. The agency believes that there are serious violations of British data protection laws.


The measures follow an investigation that the ICO carried out together with the Australian data protection authority. They now assume that Clearview AI has collected more than ten billion images of people in the database - a "substantial number" of people living in the UK are also said to be affected, mostly without their knowledge.


Not having processed data from people from the UK in a way that would be "expected" or "fair",

not having taken any measures so that data is not held indefinitely,

not having had a legal basis for collecting the data,

not having met the higher requirements of the GDPR and the UK GDPR for collecting biometric data,

not informing people of what is happening to their data, and

To have asked for further personal information - including photos - what could have prevented data subjects from not consenting to the processing of their data.


According to the ICO, it is now up to Clearview AI to comment on the allegations. Until then, the fine should also be suspended. The British data protectionists expect a decision on the matter by mid-2022.
